What Is It?

The Do Not Call Registry:
What Every Business Needs to Know

The National Do Not Call Registry is a free database maintained by the Federal Trade Commission (FTC). Consumers register their phone numbers to opt out of unsolicited telemarketing calls and text messages. As of 2024, over 245 million numbers are registered.

Under the Telephone Consumer Protection Act (TCPA) and FTC Telemarketing Sales Rule, businesses are legally required to scrub their contact lists against the Do Not Call registry before making any promotional call or sending any promotional text message. Violations carry fines of up to $53,088 per call or text.

The rules apply even if the consumer never explicitly told you to stop — if their number is on the registry, contacting them is a violation.

Important: The Do Not Call rules apply to both voice calls and text messages. Many businesses incorrectly assume SMS is exempt — it is not.

State DNC Lists
Many states maintain their own Do Not Call lists with stricter rules. Full compliance requires scrubbing both federal and state registries.
TCPA Litigator Database
A database of known serial TCPA litigants who file lawsuits as a business model. Contacting these numbers triggers immediate litigation.
Wireless Carrier DNC
Carrier-level opt-out lists maintained by mobile carriers. Included in our Pro tier for maximum protection.

The Risk Is Real

The FTC collected over $330 million in DNC penalties in 2023 alone

The Do Not Call registry is actively enforced. The FTC and FCC pursue cases against businesses of all sizes — from solo operators to national brands. A single campaign sent to an unscrubbbed list can result in class-action TCPA litigation, where statutory damages of $500–$1,500 per text message add up fast.

FTC Enforcement
The FTC actively investigates and prosecutes DNC violations. Cases are often triggered by consumer complaints.
TCPA Class Actions
Private plaintiffs can sue for $500–$1,500 per text message. Class actions can reach tens of millions of dollars.
Carrier Blocking
Carriers monitor complaint rates. High DNC violation rates result in your number being blocked at the carrier level.
FAQ

Do Not Call List — common questions

What is the Do Not Call registry?+
The National Do Not Call Registry is a free database maintained by the Federal Trade Commission (FTC) that allows consumers to opt out of receiving unsolicited telemarketing calls and text messages. Businesses that contact numbers on the registry can face fines of up to $53,088 per violation.
Does the Do Not Call list apply to text messages?+
Yes. The FTC and FCC have confirmed that the Do Not Call rules apply to text messages as well as voice calls. Sending a promotional SMS to a number registered on the DNC list is a violation, even if the recipient never explicitly told you to stop texting.
How often should I scrub my list?+
The FTC requires businesses to scrub their lists against the registry at least every 31 days. If you're sending campaigns more frequently, scrub before each campaign. Our automated pre-send scrubbing handles this for you automatically.
What's the difference between the federal registry and state DNC lists?+
The federal Do Not Call registry covers all US numbers. Many states also maintain their own DNC lists with stricter rules and shorter opt-out windows. Our Growth and Pro tiers scrub against both federal and all active state DNC lists for full coverage.
What is the TCPA Litigator database?+
The TCPA Litigator database is a list of known serial litigants — individuals who file TCPA lawsuits as a business model. Contacting these numbers, even accidentally, can result in immediate litigation. Our Growth and Pro tiers include scrubbing against this database.
Do I need DNC scrubbing if I only text existing customers?+
If you're only texting people who explicitly opted in to receive messages from you, DNC scrubbing is less critical — but still recommended as a safeguard. If you're contacting any cold or purchased lists, DNC scrubbing is essential before every send.
