1. Acceptance of Terms

By accessing or using SendMeService ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

SendMeService provides SMS communication tools including marketing broadcasts, two-factor authentication codes, customer notifications, two-way messaging, and global eSIM data services. We act as an intermediary between businesses and their customers for communication purposes.

3. Account Registration

To use our Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use Policy

You agree to use SendMeService only for lawful purposes and in accordance with these Terms. You expressly agree NOT to use the Service to:

  • Send unsolicited commercial messages (spam) to any person
  • Contact individuals who have not provided explicit consent to receive messages from you
  • Send messages that are deceptive, fraudulent, or misleading
  • Violate the Telephone Consumer Protection Act (TCPA) or any applicable law
  • Send content that is illegal, harmful, threatening, abusive, or harassing
  • Impersonate any person or entity
  • Engage in phishing, smishing, or any form of social engineering
  • Send messages promoting illegal activities, adult content, or controlled substances

5. SMS Compliance Requirements

You are required to comply with all applicable SMS regulations including:

  • Obtaining explicit written consent before sending marketing messages
  • Providing a clear opt-out mechanism (STOP keyword) in all messages
  • Honoring opt-out requests within 10 business days
  • Identifying your business in every message
  • Complying with TCPA, CAN-SPAM Act, and applicable state laws
  • Maintaining records of consent for a minimum of 4 years

6. Payment Terms

All fees are billed in advance on a monthly basis. The one-time setup fee of $99 covers your number registration and carrier compliance filing. Monthly subscription fees are non-refundable except as required by law. Overages are billed at the end of each billing cycle.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We are not liable for any damages resulting from service interruptions, carrier outages, or events beyond our reasonable control.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by SendMeService and are protected by intellectual property laws. You retain ownership of content you send through our platform.

9. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may cancel your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately.

10. Limitation of Liability

To the maximum extent permitted by law, SendMeService shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the fees paid by you in the three months preceding the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.
